If you have a receipt from the owner for towing and moorage, there should be a warranty of merchantability. That means that when he accepted money to tug and moor your vessel then adequate moorage needs to be provided. If he fails to provide adequate moorage after a contract is entered into, his insurance should be the responsible party. You should have insurance on your vessel, they would subrogate against his insurance, and represent your interests. If you do not have insurance, you have acted foolishly.
Find out who his insurance carrier is, make a claim. They may deny it, based on the facts at hand, but you have been damaged and deserve to be compensated. If he fails to make a claim, or to provide the name of his carrier and the insurance policy information, I believe you can have the police step in and compel him to comply. There should be no skin off his nose for the claim if it is denied, and you may be indemnified if his insurance covers unintentional harm to your vessel.
If he has no insurance, you may have to pursue him in court. You may need an admiralty lawyer. He has an obligation to provide the contracted service. If his marina cannot handle a draft as deep as on this boat, he has committed fraud, and sold you something he does not possess. His failure to provide what you paid for is the issue. The responsibility to make you whole is his.
Why did you not consult a tide table? Why did you not get a depth reading? Rope with a weight on it is pretty simple technology. You do have a responsibility as the captain of the vessel to protect it from harm. Knowing the tides and the depth under the keel would have saved you a lot of hassle.

It's a difficult spot to get in and out of, so it's suitable for a boat that never actually goes anywhere. The spot is big enough for a 45 or 50 foot boat, something in that size range. On a zero tide there's six or seven feet or water, and the bottom is soft. If you have questions or you'd like to know more about the spot please let me know. Thanks.
